You are not alone. I will be joining the same pool. In fact, I have already served a notice and would be leaving this company of mine on the same day on which I will be flying to India. I do not know if there will be any issues of it while coming back on AP but I would have already passed 180 days well before it.

I suppose you are doing consular processing? Right? Well, when the consulate is aware that your PD is about to be current, and if all other tasks are completed, they should send you packet 60-90 days in advance of your interview.

I am unable to determine if the 180 day timeline is calculated from RD or ND? There are different opinions here in this forum and no clear answer. Is there a law text that defines this clearly...does anybody know?

If the Form I-485 has been pending for less than 180 days, then the approved Form I-140 shall not remain valid with respect to a new offer of employment.

AFAIK, everybody needs to fill out form I-9.

I'm going to use EAD under 1099 as an independent contractor, My employer asked me to fill only w-9 form when i joined the company.
My employer doesnt know whether i should fill I-9 form (employment verification eligibility) or not?
Anybody have such experiences to share?

Sorry. I explained in the comments that go with the photo and should have included that here. This is a drinking bowl for dairy cattle manufactured by the Starline company, circa 1960. I found this in an old milking barn. The cow pushes her nose against the star-shaped lever and fresh water from the nozzle fills the bowl.

The United States Citizenship and Immigration Service (USCIS) has recently issued a fact sheet (http://www.aila.org/content/fileviewer.aspx?docid=30372&linkid=210853) reminding qualifying applilcants to apply EARLY for an Advance Parole document, as Advance Parole processing times take about 90 days.
The list of applicants who must obtain an Advance Parole document before traveling outside of the United States is as follows:
� Applicants that have been granted Temporary Protected Status (TPS);
� Applicants with a pending application for adjustment of status to lawful permanent resident (LPR);
� Applicants with a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
� Applicants with a pending asylum application; or
� Applicants with a pending application for legalization
If you are an Appllicant with a pending Application for Adjustment of Status to Lawful Permanent Resident (LPR) and need assistance with filing Form I-131 (http://www.uscis.gov/USCIS/New%20Structure/2nd%20Level%20(Left%20Nav%20Parents)/Forms%20-%202nd%20Level/Forms%20Static%20Files/I-131.pdf), contact our office, as we currently have a SPECIAL running for the preparation and filing of the Advance Parole (http://www.h1bvisalawyerblog.com/2009/10/special_ead_and_advance_parole.html) document.

your site is not a good intro for business.
"home", "about" and "services" all link back to index, no content, no details about who is behind this, the examples provided in "portfolio" are not even clickable, and worst, the mail link doesn't work from index.html as it's misconfigured (emailto instead of mailto..), only from the portfolio page, but on this page, the link on the portfolio menu is wrong,
basically, you better hurry and get that site done if you're looking for jobs...

i hv an approved I-140 thru employer A (my current employer). so i am eligible for 3 yrs H-1B extension. the I-140 was approved more than 6 months ago.
once my H-1B extn is approved for 3 yrs, i want to xfr my H-1B to employer B. in that case, if employer A revokes the I-140, then what happens to my H-1B extn? does that become null and void?
pls. note that I-485 is not filed, so i cannot invoke AC-21.

I have traveled many times on AP and not once was I asked about EAD/797. That said, there is no strict rules. Maybe you can keep a copy of the above documents and explain why you lost the originals.

From many sources I heard, once you start using your AP you have to use EAD (that means you are ignoring/abandoning your H1B processing). You can't be in both EAD and H1B status.
Please ask your attorney for firsthand information.

Thats ok even if she doesn't have AP. That is perfectly fine. Don't worry her H4 is already stamped and she has time till next year. She is totally safe even if she does not have AP.
