I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.

My mother came for a 6 months visit on December 10th of 2010. But she left in April of 2011 (April 9th 2011), two months short of her 6 month's stay. Can she come again in August 2011 for a six month's stay, and stay till Feb 2012? Or will she have to return in 2 months? (return by October 2011)
My mother has 10 year multiple entry visa.
I heard that a visitor can stay only 6 months in a year, is it true?
If yes, is the calendar year counted from January to december?

Are there any rules that you need to leave a country during 30 days after your H1-B got approved. Almost all my friends needed but my lawyer said that I don't need to. I am confused what if he makes a mistake.

Hi Gurus,
Please suggest me the best option as i am still undecided.
My employer terminated my employment when I lost my job with the client company during 2nd week of June 2009. Before termination, my employer filed my GC and I have my EB2- 140 approved (PD- Feb 2007) and also My previous H1 extended last year 2008 and they have issued my visa for another 3 yrs (3rd term in H1). Since then I am without job and looking for an opportunity. But to be on safe side I left the country before the 30 days of my termination. I came back to US on H4 visa (so that I will be in-status and my GC won't get affected).
Now i am getting an opportunity for a FT position with a company and now I am undecided what to do? If I took the FT with a new company and then my GC process will start from beginning (applyng labor and then once approved (don't know how long it will take to approve labor in EB2) I can then file for 140 porting my previous approved 140 -eb2 with PD Feb 2007) or Just wait until I find a contract job and go through my previous employer and continue my GC process from where it is left.
Currently the PD for EB2-I is in 2005. So should I wait and go smoothly with my previous employer (but still we don't know how long it will take) or go with the FT.
Please suggest me.

one lawyer whom I spoke with says it is still ok...basically they need senior applicants in their field who has done some supervisory work and can do managirial work..I don't know how much it is true.

You dont have to apply for a COS as long as she is leaving US before her current I-94 expires. However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

It is possible. There is a relatively unknown technique called TT (abbreviation for Time Travel) which is also relatively related to relativity. When applied correctly, it is more effective than PD recapturing and labor substitution. That's how I got my green. I understand that after getting your 45day letter your case will be in the BEC database and will be processed in order.
Now I just saw people on this forum with PD Aug 2003 got approved 10/17.
and I know a friend with pd oct 2003 got approved in April.
Suppose that the guy got approved 10/17 was input to the system after the other luckier guy, the most conservative estimation is now pd Aug 2003 is being processed.
Anybody heard of any later PD being approved recently? from DBEC?
I'm just thinking, if we share the pd/approval information on this forum we'll have better estimates about our cases and have a somewhat less stressful life.
