Hi,
I am really confused about my current status.
I am currently on Opt Extension, which expires on June 1st 2010.
When i filed for H1b visa last year April 2009.
I got my petition approved, but my change of status was denied.
The reason was stated as :
The status previously accorded the worker had expired before this petition was filed. Therefore, the worker si not eligible for change of status.
Now, I am still in US. Is my status illegal?

I am not sure if someone is in same situation.For my I140 it says the following
Current Status: Document mailed to applicant.
On April 1, 2009 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
I am not sure what does this mean. If some one can throw some light.

Hi,
to stay away from india while on AOS, you need AP.
to maintain AOS, one needs to keep renewing AP.
So when you apply/renew AP candidate needs to be here...
So your daughter will apply for AP, get it , travel... come back 6 months prior to AP expiry, go to india and study and you will send AP by mail ...
she will come here every 4-6 months prior to AP expiry and renew and go back.
You need to give a sound reason in port of entry why you are staying away for long durations..!

I posted this on my facebook. Just to spread the message. I think most people think immigrants steal their jobs, but the truth is sometimes we struggle to hire a local person and then a foreigner walks in with the skills we need, but we can't hire him. (this is not to say we have not had good quality local people for the job as well)

No, not necessarily in my opinion. She has legal F1 status and that is what you will show on the relevant forms.
I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
Will appreciate if anyone has had similar experience and is willing to share.

Hi Simi,
The fact that the company that sponsored your GC shuts down or files for bankruptcy should not have any impact on you. As long as you have an approved I-140, an I-485 pending more than 180 days and a job offer in the same or similar occupation, you are protected by AC-21.
It would be prudent to make sure that you now have copies of all documents relating to your GC case, including complete copy of LC, I-140 petition and supporting docs, H petitions, pay records etc.

Hi,
company A did H1B and H4 (both approval notices. No Visas stamped yet)
company B is doing H1b only. Can the dependent candidate stay on company A's sponsored H4 approval ?

No need to file H4 till her current H4 expires. As long as you are maintaining continuous H1 status (without gaps), H4 would remain active till its current validity even if primary H1 applicant changes jobs. You can file her H4 extension of stay petition 90 days in advance from the current H4 expiration date.

Does any one tried accessing USCIS case status online webpage while doing so it replied back to me saying "403 Forbidden" generally for any blocked IP's i emailed USCIS webmaster requesting why it was so as i could see my case status online a day back. Any one in same shoes? I am not worried and i feel there is no reason to get worried as most of security issues are due to false positives. IF any one in the same shoes lemme know your views.

Thank you for the reply. My confusion stemmed from whether i can use my US License as my id for gaining the license. Or whether somehow my A# or I94 number had to be noted on the license/certificate in order to use it at a later point for the green card process.

Hi,
I'm on L1B and wife on L2B with EAD and currently working. Both are expiring on Dec 30,2010. I got my H1 with COS, which is effective from Oct 01,2010 for 1 year and my wife got H4, effective from same time. My wife's company is filing for H1 for her and has already applied for LCA. After the LCA, they are not sure whether to apply for COS from L2 to H1 before Oct 1st or if they want to wait till Oct 1st and then file for new H1 with COS from H4 to H1. In the second case, she will not be able to work till she gets her H1.
Also if they file for H1 before Oct 1st with L2 to H1 COS, and if she gets RFE, then not sure whether the whole application is invalid as my wife's status would have changed from L2 to H4 during the course.
Please advice my options. Is it OK if her company file for new H1 with COS from L2 to H1 as soon as her LCA get approved with premium processing? Is it going to be a problem if she gets RFE?
Or is it adviseable to continue to be on L1/L2 till she gets H1? If yes, how can I change my status back to L1 before Oct 1st 2010? Can my company do it me? How long the process will take? I also heard that if I go abroad and come back, I will continue to be on L1. In that case should my wife acccompany me? Do I have to go out and re enter before Oct 1st?
If I change my status back to L1, what will happen to my H1? Will it still be valid? If I'm planning to change to a different company, can it be just transferred to that company and I can work there?
