I have a question, for my fresh petition 2010 will it be subject to the H1B CAP??
There are many diferent opinions, i too understood that renewals and extensions wont be subject to cap. But there is no clear statement on my scenario.

Hello Gurus,
My 6 years H1B visa term is expiring on Apr 30th 2008. My company filed 3 years of extension on approved I140 basis, which is still pending as of Apr 30th 2008. And my I 94 is dated till Apr 30th 2008.
I filed my I 485 in June 2007 and got EAD and AP
1) What will be my status after Apr 30 2008. Will I still be on H1 status, if not what will be my status.
And what is 'H1 pending for 240 days rule'.
Your answer is very much appriciated.

Until you get any decision on your H1 extension, you are still considered on H1.

Hi there,
This is exactly what my company's attorney had told me. If the new location is within commuting distance/same metropilitan area there is no need for a LCA amendment .
If anybody thinks otherwise please feel free to correct me.

I was in a similar situation as you and had to use this firm. H1B filing experience was fine but the entire GC process and filing was not a good experience at all. There were days I had to call the paralegal and teach him the new immigration laws and that's never a good sign ! Because of their mistake I was stuck in Eb3 rather being in Eb2. May be they will deal differently with your case but have a chat with them and your company managers before you agree to use them. I m with another company and another attorney firm and they are awesome !

Hello Guys,
Do any of you received finger prints notice who has E-Filed EAD renewal between June 25th - June 30th.
We filed on June 29th with Texas Service Center and it's been a month we are waiting for FP notice.
I appreciate ur help.

I got a D80 a little while ago, and am slowly learning how to use it. I used to use my dads D70, but decided that it was time for a DSLR of my own. Anyone have any tips or tricks that they have found along the way?

If you have worked illegally for < 6months you may be covered by this..if its > 6 months.. go out of the country and come back in with a new i94..

I think most the news that H1B's are turned back @POE are not ture. My wife just got her second H1B stamped at kolkotta embassy ( end of jan) and we came back through JFK on Feb 14th. I am on my second H1B. Not a single question was asked. Again Not a single question was asked for first time. Before they used to ask the name of the employer or ur position. We both are permanent employees for a big company ( think of iPhone) and done our MS here. based on my recent experience I do not see any problem with you.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.
Tourists -> They support themselves financially during entire trip
Invite -> You support them financially during entire trip
The chances of getting 10 years multiple entry as a tourist is less likely, if they apply as tourists. Again, it is up to the I/O.

Contact a good attorney asap. Your details would most probably raise anyone's eyebrows at USCIS/DOS/ICE. Also, a lot depends on exact dates when you entered/left US and when your different applications were rcvd by respective govt egencies as these details will help you to establish that you are not in violation of any US laws.
