(Annual Report pp. 32-37)
In FY 06, over 10,000 visas were lost because of slow processing of EB cases, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards. As of May 2007, the
State Department estimated that 40,000 EB visas may be lost in FY 07 if USCIS does not increase the
processing rate for green card applications. The Ombudsman attributes the slow rate of adjudications to inaccurate statistics and inefficient USCIS management of its workload. The problem will become significant in the coming fiscal year if there is a dramatic increase in EB green card applications, and a significant backlog is likely to develop if this problem goes unaddressed.

Hello,
My friend has H1 and working for company A. He transferred his H1 and started working for company B (Its been 4 weeks and he has 2 paystubs from company B).
He is sure that company A didn't revoked / cancelled his H1. Now he wants to move to company A (old one). Is this possible?
or does he need to re-transfer his H1 from copnay B to company A?
Please advise.

DMV has accepted EAD with Last name as LNU though the passport do not have any surname . They have issue DL with LNU. Life is moving on.
When I checked with My lawyer about "How to correct at 485 filing" . My lawyer belongs to one of the big corporate lawyer firm (USABAL)
1) correct the name at password . we can send the passport for name split .
if you do not have this isse then ignore
2) Wait for GC CARD
3) File some kind of form to get the replacement card --(we need to attach some proof with form) . Lawyer is going to file for us.
For now just waiting ...

Hi All,
I am new to this forum. My husband is working for a desi consulting company and they also filed for my h1. Now my hubby is planning to move out.
When my hubby moves out they might bargain using my h1 approval.
They havent given me a copy of the H1b approval. Could some one tell me the reasons to get the I-797 copy from the consultant?Once I get it I would like to transfer to some good company.
I heard that there is a I-824 form requesting copy when the actual approval notice is lost. Can I file for that and it seems it takes 6 months to get the actual copy.
Does the info pass help here ?

When 140 is denied, then 485 is also denied. Appeal going to AAO is common thing. Will sit there forever. Its takes approximately 12-20 months to get a reply.
Mine is already crossed 12 months now.

actually there is, if you do it my way you see an x, y and z level: there you can enter numbers, for example x= 3 and Y=5 and then you will see he will rotate differant.

I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.
You will need to have the petitioner file an amended petition only if there has been a material change in the terms and conditions of your employment.
Compare the job duties (not just job titles) of the original and new job to determine if they are in the same Standard Occupational Classification (SOC). See, Find Occupations (http://online.onetcenter.org/find/). If the jobs are in the same SOC, they would both have the same prevailing wage and no material change has occurred. In that case, you may only need to get a new LCA. All LCAs take up to 7 business days to get certified by the DOL. In your case, Software Engineer and Programmer Analyst are probably materially different so an amended petition is most likely the best course of action.

That is correct. If your employer is enrolled in E-verify then he needs to updated your information in that system otherwise just keep the form for record.
One correction - the employer does not update anything in E-Verify. It is a read-only system to the employers to verify the authenticity of document provided by employees.

Doing a AR11/Change of address, do I include all these as additional applications
1. MTR number
2. Appeal number
3. Original 485 (denied) for primary applicant
4. Original 485 (denied) for spouse
5. Denied 140 number
or just these

Also, i have a pending date-error request with my H1B and H4 extensions, do i include the H1B and H4 numbers as well.
This is getting complicated and i have just 2 more days before the 10days rule for filing AR11.

Today I had an Infopass Appointment at 10 am. The IO told me, my NC is pending that's why I did not get FP.He told me to wait till July (ie is one yr from the date of applying)then open SR.

I should mentioned the Customer service number too. it is in the link also. One of the option when you dial in, is for "Change of address".
Applicants and Petitioners with pending cases should telephone customer service at 1-800-375-5283 to report their change of address and get the address on the pending application/petition changed.

If you signed G-28 and authorized Attorney to do that, yes they can sign the application on behalf of you and send it.
