    Hi,

    I lost my job on 7th Nov 2008. On the same day I received the offer letter & my H1 transfer was applied by the new company. This new company goes by rules, so they are waiting for the H1 receipt. They have not applied H1 trasnfer in premium processing.

    My questions are,

    1.) What time is it taking to get a receipt by USICS? (NON Premium Processing - I�m in NY City - so probably Vermont Center)

    2.) Do we have any rule in written (Official), that as soon u apply for transfer, without getting the receipt; you can work for the new employer?
    (So I can show it to my new employer)

    3.) Can I follow with USICS? Have they received my application for transfer? How to contact them? What reference should I give them, to find my application? (I don�t have tracking number - FedEx receipt)

    4.) What is the time taken for the H1 Paper, to be delivered after receipt, by USICS?

    Trust me this is so frustrating, U can�t join because of all this paper work.

    Please respond ASAP.

    NOTE: Also please let me know , when u had applied the same.

    Hi all,

    I think my scenario is little complicated.I have my I140 (EB3) cleared with previous employer and my current company has filed new labor and I140 (EB2). They are trying to capture the priority date of my old I140 approval (August 2006).

    While my current I140 is still going on, can I apply for I1-485 due to sudden improvement shown for EB2 category in September Visa bulletin.

    Please advice.

    I believe that is still possible. There is some talk about discontinuing the concurrent application process, but it is not a rule yet. so you should be able to apply. Talk to your lawyer about it.

    Hmmmmm....

    How about this...

    After you applied your 485 and work for the same company for 180 days, also you got your EAD. .....

    Can someone change the employer afterwords (after 180 days) without worrying about H1B visa renewal/transfer?

    If so what are the requirements....common guru's give us some hopes....

    If she is out of the USA, what you could do is file a 'follow to join' petition with the US consulate in your country when your PD is current. You could file this if the marriage occurs before your GC is approved.

    Also if you can set aside some money for >3 years, putting it in an NRO term deposit is also pretty good. Now they range around 7.5 to 8%. You can repatriate the interest income after due taxes are paid.

    Thank you for the response. I guess one more follow up question. Since I already have an H1B stamping (visa) in my passport that is valid until September 2011 (which lists Company A as my employer). If Company B were to successfully apply for a transfer from B2 to H1B, if I travelled outside the USA, could I still return to the USA with my old H1B stamping in my passport or would I have to go to a US Consulate and get another H1B stamp (visa) that lists my new company?

    GC Status: Filed in EB3, PD OCT 2004. I-485 not filed. I-140 status : Approved
    Visa status: My LCA/H1visa end date is March 2011.

    Situation:
    I am on 7th year extension.H1 extension was approved based on approved I-140. H1 extension is set to expire in March 2011 (7-8 months)

    There is a need for me to switch current employer.

    1. Can the PD ported thru the next GC process by new employer, even if the I-140 is cancelled from prior employer ??

    There is no fraud or any misrepresentation and if prior employer cancels appoved I-140.

    Please provide insight in this case as how the USCIS officer takes decision on PD porting is concerned ?

    If you are born in UK and if you apply for labor certification under EB-2 category (job requirement: Master's degree or BS+5 yrs exp) then your priority dates are current and you can file for I-485 and get your GC in about 1.5 yrs...(ofcourse only if its not stuck under name check or any other complications...)

    Hi,
    I am a computer science graduate from India ( 4 year engineering degree course) with 3 years experince in SAP. A reputed company in US has agreed to process H1 for me. They have only asked for my educational certificates. My experience certificates were not submitted since they said it is required only when you go for the H1B at the US Embassy.

    My query is wheather experince certificates are required for applying H1B.

    I do not think being on h1b on only 6 month would be an issue. if he is going to take care of all expenses of their visit, he would have show enough saving + salary to support them.

    With full due respect to the extremely hard IIT JEE and the brilliance of the students that make it to the IIT , the reason that only 3500 make it from over 150,000 is because of India's staggering population and staggering student numbers . The US has less than a third of US's population and hence Harvard accepts 10% . It is simple math.

    I feel that just because a person could not crack a question in IIT JEE and gets rejected makes him any less smarter than the ones who make it given the small number of seats that used to be sometime back .

    It is good that ye government has now opened a lot more IIT's and IIM's so that more people can get the privilege of going into these elite institutionalism , the ones who missed the Institution because they could not crack one question in the JEE .

    Hello Guys....,

    My and My Spouse I-485 & FP, EAD and AP all checks cleared yesterday and I found the Receipt Number on Back of the Cleared Checks. But when I check the status on the USCIS System. It says check the receipt Number. Is any one face this type of problem....? Please advice. Thank you.

    My I140 is approved and my I485/EAD/AP was applied last month and nothing is approved yet.

    The company finances are not looking good , if I lose the job then what would happen to my GC application. I am hoping to get EAD before company pulls the wire on me though.

    What would be my best options. Please reply ASAP

    It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic.     I have exactly the same question.

    If you look at VFS appointment scheduling if it is more than 1 year that your 797 was renewed and if you did not go for stamping they put you under different class of renewal.

    You can check this by going to VFS appointment site and there they ask the question are you applying for the same class of visa that got expired 1 yr ago or something like that...

    Can anyone shed some light on this. Since i am on the same boat like the person who asked this question.
