    It actually depends what nationality you are, since that CAN mean a huge amount of difference with the speed of getting your greencard through EB3 or EB2.

    I'm in a similar situation, and could apply in the EB2 category, if I decided to change my job, however, I do have a good deal of company loyalty so I am reluctant to do that.

    If I did that, my EB2 category is current, my EB3 category is retrogressed - but I value my job and quality of life at my current company higher than the risk of moving to another job JUST to get a greencard quicker

    You should eligible for Eb2 by default because of your education unless your current job does not need one..

    It is nothing to do with the individuals education level, a person with a PhD would qualify for an EB3 only, if that was what the job description stated

    I have written the ombudsman with an update after their initial inquiry and two of my state senators regarding this. I am confident we sent everything requested in the RFE but it's my word against theirs since we have sent it a total of three times; in the original application, then for two RFE's. Obviously, they are not very competent or they are not telling us what document they really need becuase they keep asking for tax docs.

    I only have until May 12 to make a decision because they sent the letter of denial out so late compared to when they dated the denial. By the time the ombudsman gets back to me, my window of opportunity to file a motion will be gone.

    It's so frustrating to deal with these people!

    Thank you guyz for your responses.

    I understand if G-28 forms are not sent, then all correspondence will sent to me which is good. But my concern is what if my lawyer signs the forms as a representative and not sending G-28 forms to represent the case.

    This is the process which i have gone through:

    1. My lawyer sent the questionnaire forms for 485/131/765. I filled the forms with my personal information and sent them to him online.

    2. He made the necessary corrections and filled some gaps and sent them back to me for my signature. At the end of each form his name and address is printed as a representative of my case. He asked me to send all the forms signed along with reqd. documents.

    when his name and adddress is printed and he signs the forms, then it shows he is representing the case. Then he has to send G-28 forms for each form I guess. If he didn't signed the forms as a representative then I guess all correspondence comes to me but my concern if he signs the forms but not sending G-28 for each form, then I guess I am in trouble for not sending G-28 forms...am I thinking correctly...suggestions plz...

    My lawyer is not that responsive. He always says(pretends) that he is busy(not sure though)..I send an email but no response yet. If really G-28 forms required and if he sends the packet without them, then as per USCIS my application will be rejected right away. No time to reapply also.

    Congrats. Good to see an EB3-I approval. This is something we get to see rarely here. Hope you are able to celebrate with your family soon!

    I filed my case on July 17th to TSC. No Checks cashed yet / No receipts.:mad:

    Today USCIS supposed to release bulletin. I hope TSC/NSC moves 5 more days ahead.

    I have a question though : Will USCIS releases bulletin like this once both service centers dates touched Aug 17th which is the last date of submitting 485 applications due to July visa bulletin fiasco.

    I even checked Oh Law firm website and they posted still 400,000 applications were waiting to be processed.

    Any thoughts about this?

    Both of the following are about 500KB, so beforewarned...

    I put a smaller beetle macro into the front-page gallery area, but here's a couple others.

    1 Upclose and personal with a dandelion.

    2. The same lens, used conventionally for a landscape. I printed this out at 19x13 and it's going to get framed.



    Nice shots.......... I like the close ups with Macro, and also the landscapes with the old buildings overrun with ivy

    How to find associated SOC code with DOT code (DOT code is on LC certification, OCC code , Ind COde and OCC title is on certified LC)? I tried to find my case in the MS Access databases (from year 2001 to 2007) but could not find my case at all. My PD is May 2004, and LC certified March 2006(was sent to Backlog Center in Dallas), which MS Access database do I need to look into?

    My title on LC is programmer analyst (OCC code= 030.162-014), read thru the forum replies, found that programmer analyst have OCC code= 030.162-014 and SOC code=15-1031, most of them found their SOC code from MS Access database(some found in their Certified LC??? ). I am presuming my SOC code to be 15-1031, but wanted to confirm that. I am debating on invoking AC21, but need to make certain SOC code matches with future employer (future employer gave me job code as 15-1031) as my future title will be totally different (instead of programmer analyst, it will be IT Business Specialist).

    Any help/hint will be highly appreciated.

    this is not correct. You can use EAD to work wherever and whenever you want. If you get laid off after let say 1 month from filing, it is safer to transfer h1b, but it is not true that if you use EAD you should go back to original sponsor.
    You must only go back IF AOS IS APPROVED within 180 dyas from filing.

    Payroll tax is same as employer tax. There are 2 or 3 components of the taxes that employer pays such as Social security ( employer portion), unemployment tax, Medicare ( employer portion)

    also employer will need to pay for payroll company such as ADP a fee to maintain payroll, do filings

    Thanks Surabhi......So does my assumption correct in terms of the percent tax an employer pays which is between 8 to 12% depending on the state he is operating which inlcudes all the components you mentioned except the payroll company fee(i,e ADP or intuit or etc)? The reason I ask this is b'coz I am also planning to work on W2.

    You can have 2 H1B active at one time, but one should be fulltime and other which we call as concurrent H1B (part time).

    As per my understanding Concurrent one does not fall under quota since it is a part time one and needs to be approved before you can start working unlike h1B transfer where you can work as soon as transfer is filed w/o waiting for approval.

    The underlying H1B or the concurrent H1B does not protect you on status, so if you loose status on your fulltime h1B job then you cannot jump on this to save your status.

    I like 'em both. Like Steve, I think the dandelion is surreal and "way cool". But I do have a question with the ruins photo. I'd like to kinda turn this members' critique back on you, if you don't mind. Maybe I can learn something...hopefully this isn't out of line in this forum....if so, my apologies to all.

    Initially, I really like the photo, and as I stare at it longer I see more and more reason to like it. At first the greenery seems part of the ruins, but as my eyes hold on it for a moment, the green soon pops out into a more 3D presentation. The colors, the composition, the uniqueness....all is very appealing...and I don't know why.

    But.....here is the question....what "makes" this shot? Let me clarify...I am an engineer and my left lobe tends to see in the B&W and straight lines of life. The artsy stuff doesn't come easily for me. When I see something that is right, I know it. It's just difficult for me to arrange something to be right or to see the perfect image inside a lot of clutter. I'm convinced that I would have gone right past this one if you hadn't pointed it out to me with this posting.

    Bottom line.....this photo....what I'd like you to do is to critique your own work. Tell us (me, in particular) what makes this such a good shot? What elements bring this frame together? What do you particularly like about this shot? What would you change or do differently? Help me to "see" why I like this photo. What "makes" this shot?

    Other Dphoto pro's.....same questions. WHAT are the elements work so well here? WHY is this a good shot?
