Hi,
I have been offered a job with a company who has an approved labor of Priority date Dec 2002. Seems like a good deal but I wanted to know if Labor Transfer is still possible. I mean Labor can be transfered from someone's name to mine.
Please respond ASAP.If I can get a response it'll be great.

Do they really know our name check status in local INS? When I spoke to NSC an year back, they said that my name check is done and waiting for visa numbers. when I went local INS office recently, she simply checked the online status (which we used to login and see) and she told that my name check is pending. It's been 4 years since I filed my 485, how is this possible?

Dear Fellow Posters
After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.
My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?

H1B visa and it got approved, which is yet to start from Oct 2010. But now I
got an offer from Company B. I have to get my H1 transferred to company B.
I have informed my current employer(Company A) about this transfer.
But actually they(company A) are planning to withdraw my H1B visa petition
from USCIS as I will not be working with them from Oct 2010.
I would like to know if this will affect my visa transfer.
Can someone please let me know how it works and suggest me what should I do
to get my transfer done?

You can transfer your H1B before Oct. There is an option in the H1 application for that. I don't remember the exact wording, but one of my friend did this last year and it was approved.

I just did that, from Sr sw engr to sr sales conslt. Corporation would not care for details of AC21 , however if and when u send in AC21 letter to USCIS, make sure your job duties match that of ur previous job. rest shd be all cool. The new job u r getting into, is it a big firm and small?

Dont worry too much. Get your H1 extension with current employer even if it s a consultancy firm when you are on project. It wont be deied.
I think I wasnt clear with my 1st post.
A different employer has file my labor. I do not want to file a new GC with my current employer. New employer is saying that H1 wont be transferred without client letter.
So I am trying to figure out other possibilities in the meanwhile.

The answer is Yes you can switch to new employer. Your H-1 does not matter anymore as you have applied for AOS and you have a valid EAD which you can use for AC21 portability for a new employer after 180 days.

2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
3. Hoping your employer does not revoke your I-140
4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

The employer has to always pay the H1B fees.
I know govt said anything regarding labor certifications etc are now only to be paid by employer...
what about fees related to extensions of h1 b? can i still pay for it or it's employer who has to pay...cause knowing my employer i know they won't want to pay and i wonder what options i have.
