Hi
I am Technical Director and have been working in the US under o1 visa for 2 years
This visa has initially been sponsored by a company, so I can only work for this company
A lawyer told me that I could self-sponsor another o1 and then be able to work for as much company I want. I have an agent but he is not able to guarantee full time employment.
So I am wondering if I should do that or not.. What are the exact salary requirements for a self-sponsored o1?
I got a good folder, awards, recommendations and publications.

After filing 485, Is AC21 based changing employment is legal only when using EAD or it is applicable for H1-B transfer as well?
History - I filed my 485 in EB3 PD March 2004. Married after that, waiting to file my wife�s 485 for PD. Hence I am maintaining my H1 as well as H4 for my wife.
I can�t use my EAD.
I am working as software engineer at a client location for the past 8 yrs. A corporate wide new policy at client location forces me to take full time or quit the job as not allowing a contract for more than two years continuously. I work for a very small American Consulting company and one or two employees in W2. Hence my option to get another client is very limited.
I like to see what are the options legally can be possible without affecting my GC and legal residency of me and my wife.. I am now on my 11th year on H1 -B
Can I switch to new employer with a H1 transfer (not using EAD) using AC 21 where the 485 was filed by different employer. Is it possible / I mean using H1B to a new employer not EAD. And extending the H1-B continuously?
In case if I switch my job, and if the PD become current what are my options? Is my existing 485 application still valid? Can I file my wife�s 485 during the time.
Can I continue extending my H1-B based on my old I-485 EB3 with the new employer more than one time. assuming my PD may take more than another 3 yrs.
Do I require to start again my GC process? Or Can I continue with the same existing filed application?
I can start a fresh GC with the new employer with EB2 as I gained another 6 yrs experience. But don�t know how long it takes, Can I continue extending my H1-B based on my old I-485 EB3?

I am happy to read this. My observation is that Indian-American US citizens generally don't care about the Indians who are going through the process of immigration. In November 2005 when some one approached IAFPE with retorgression problem, their NC chapter conducted a seminar in Raleigh and some 100+ members did sign a petition. But they handed over petition to Bobby Jindal and it looks like from what is reported elsewhere on this site, he belongs to anti immigrant camp. But except this seminar even this organization did not take more interest in this issue. But I hope India Community Center has shown way and more Indian-American as well as Chinese associations would come forward to support the issue. Can some one approach Asia Society in DC who last week organised a speech by President Bush?

pappu, ur link talks abt GC in EB-5 category. is the requirement of $1 mn investment a reqd condition for this? in other words, if an enterprise can generate jobs for 10+ US citizens by investing a lesser amt, is that valid for filing GC under EB-5 category?

From my experience The people at the national center have no idea whats happening when compared to the guys at the specific centers. The national centers issues generic solutions. (Say fill a form and wait for 45 days. If after 45 days there is no answer they again send the form, etc) If you really want to know more or get proper action, the people at the specific centers will have to be contacted.
The old way to get to the specified center is back. Dont listen the messages, just press the order of the buttons and it will work.

I am on H1 visa. 485 pending, and have EAD. However the 1 yr period of EAD is nearing, the EAD expiry date is Aug 20. We have already applied for EAD renewal and have recieved 'notice of receipt' for the application.
My question is can I use EAD and change job while EAD renewail is in process? The problem is that the current employer may be closing this dept in few weeks and therefore, I will be losing this job. I would like to know if i can join a new job while EAD renewal is in progress.
Any suggestions please

I suggest to go with extension. U can file for extension 6 months before the expiry of H1. so Apply in next month (if applying in regular) or in oct or nov (if applying in premium). Passport expiry may not be an issue for extension.
In my case, i have applied for extension(in regular process) 5 months before existing H1 expiry, where as my passport is just valid for 2 months after existing H1 expiry date. Didn't face any issues in getting approval.
May be u need to check with Attorney for one scenario where due to RFE if the extension is pending beyond 5 or 6 months..
Based on my experience I'm suggesting this.. better check attorney or experts also.

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?

No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.

This question is for an attorney:
My spouse's case is this: She has applied for AOS I-485 (India) based on an underlying EB3 I-140 (PD feb. 2007) petition during July 2007. At that time she had also applied for an EB2 NIW self petition, which was recently approved in April 2009.
Two issues arise now:
a) The PD date of the newly approved I-140 is August 2007.How do we inform USCIS to capture previously approved EB3 I-140's PD. She has used AC21 to port to same or similar job, but he previous EB3 I-140 has not been revoked. Is it possible to capture previous PD?
b) Do we have to send new I-485's or can we ask USCIS to interile newly approved EB2 NIW I-140 to the already submitted I-485s. If yes, how do we do that ?

I want to apply for my 3 yrs H extension using preminum processing. Can i do that by just using the email confirmation from USCIS that I-140 petition was approved? My 1-140 petition was approved in Dec,2006 and still have not recived my approval notice.

ok this is a little unusual, my exp so far has been the checks are almost always cashed within 3-4 days, call cust center or take infopass and follow up, if you have a lawyer then ask him to check on it.
However i am not sure why your application reached VSC.
We have been applying for advance parole document at NSC for the last few years.
This time also we sent our application to NSC on 01/28/2010.
However, after about 15 days, we received a receipt notice letter from Vermont service center and the case is now pending at VSC. Moreover, the check is not cashed yet.
Based on the state we are living, the I-131 application instructions specify that I-140 based applications should be sent to Nebraska service center.
I am wondering if USCIS started processing I-131 applications at VSC.
Or our application is mistakenly misclassified and sent to VSC.
Any comments?
